A ‘class period’ defines the timeframe during which injury or wrongdoing occurred. This period is initially determined by plaintiffs’ counsel after extensive research and investigation. Sometimes the class period changes during the course of litigation based on additional information uncovered during the discovery process.
Class actions can be complex and can sometimes take years to settle. Class members are typically not affected while the parties are litigating. Once settled, affected will be notified of their rights and options. Once a case has settled, this process typically takes 6-12 months.

A Settlement Notice is a written document describing settlement terms and outlining class member rights under that settlement.
The amount you receive will depend on numerous factors, including the size of the recovery and will be discussed in the Notice of Class Action Settlement.
Tax responsibility for any distribution depends on the type of settlement reached, and the treatment of the claimant’s investments/activities regarding that claim. For example: Wage claims will be reported on an IRS Form W-2 and applicable State and Federal withholdings will apply. Please consult your tax advisor for any specific tax consequence that may apply to you.
Patience is key when making a claim on a class action settlement. Once you make your claim, you must still wait for the claims period to end, and for the judge to review the case at final approval. On average, the entire process takes 1-2 years. Additionally, settlements are sometimes challenged by attorneys looking to change the terms or include themselves in it, or an objection is filed. This delays payment since it cannot be disbursed until all challenges are resolved.
